Agent Tip of the Week!

Price vs. Value
 
To start, a sale “price” is the amount of money that the buyer agrees to pay for, and for which the seller agrees to transfer, the property.  Think of it as the “exchange” price.  Based on a widely variable set of determinate and indeterminate factors, this amount may be very close to, or very far from, the “market value” of a property.  “Price” is just one element to be taken into consideration when determining “market value”.  Often it can be the most predictive element, but that does not make it equivalent.
 
What about the potential for a change in property use?  Or the zoning classification?  What about an easement or some other key entitlement or restriction?  Would any of these variables affect market value?  Of course they would!  Without a detailed analysis performed under recognized methods and techniques, and using current data to consider all three major approaches to value – income potential, comparable sales and replacement costs – and then reconciling those relevant results, a fair “market value” cannot be reliably determined.  And these skills are precisely what an appraiser is trained and licensed to do.  
 
This is why the lending community relies almost exclusively on an appraisal report to estimate the “market value” of the collateral property when making a mortgage loan.  A Broker Price Opinion (BPO) just won’t cut it.  There are many circumstances for which a Comparative Market Analysis (CMA) or a BPO provide the kind of information needed to assist an owner or the owner’s agent in evaluating the options for dealing with a specific property versus the structured, detailed analysis provided by an appraisal report.   But that does not make them equivalent.  A BPO or CMA is not a comprehensively sufficient analysis to establish “market value,” though it may be done competently enough to support a likely sales price “prediction” or a listing marketing “strategy”.
 
So unless you hold a current appraiser license, the safest approach is to avoid using the term “value”.  Instead, you should use price “estimate” or “prediction”.

    • Date & Time
    • Location
    • Class Description
    • Prerequisites – please review these in advance. You may need to take a class prior to the one you are considering or you may need to have specific items completed before the class. These prerequisites are for a reason. They are not to prevent someone from coming to class, but they are meant to assist in our classes providing exceptional content and being able to stay on the intended topic. If you have questions about the prerequisites prior to attending class, feel free to contact the class instructor or the class organizer who are listed in the class.
  • Register for the event/class
    • In the details section of the training/event select the blue “register for event now” on the top right of the page to register
    • Remember to register for all classes you are attending, this is important!
  • You can add this calendar to your personal calendar by selecting the “Subscribe” option at the top of the calendar. The Office Calendar are all office events, the “My Events Calendar” are the events you have RSVP’d to attend. Choose the appropriate calendar, then select the type of calendar you want to add it to, for example, Google/Android, Apple/iCloud, Outlook, or Other. Then follow the step by step instructions. These calendars will not interfere with your personal calendar, as they can be selected “off” and “on”.

Agent Tip of the Week!

 Competence and Licensing
 
You may be a great contract negotiator, but you know you cannot write substantive provisions into a client’s contract unless you have a law license.  You may be a very skilled closing or escrow counselor, but you cannot perform certain escrow or closing tasks without an escrow agent or law license.  You may be highly accomplished at estimating mortgage qualifications for customers or clients, but you cannot underwrite and originate a loan without a mortgage loan originator license.  Similarly, you may have tremendous skills in estimating the likely sale price of a home, and even more so in the marketing strategy of recommending a listing price based on that analysis, but that is clearly not the same as the detailed process used to establish a “market value” for purposes of collateralizing a mortgage loan.  Establishing a “market value” requires adherence to the Uniform Standards of Professional Appraisal Practice (USPAP).  And in Texas-like in most states-performing that task requires an appraiser license.
 
As a license holder, you are allowed to create a CMA or BPO relating to the estimated price of real property as part of the ordinary course of business if the analysis, opinion or conclusion is related to the actual or potential management, acquisition, disposition or encumbrance of an interest in real property.  Most importantly, the CMA or BPO cannot be referred to as an appraisal, and you are required to use a disclaimer that specifically informs the user or reader that this is not an appraisal and was not developed following the guidelines in the Uniform Standards of Professional Appraisal Practice (USPAP).  See Tex. Occ. Code Sec. 1101.102(1)(A)(xi) and Title 22 TAC Sec. 535.17.

Red Day 2019 is now in the books! A shout out to Lori Lesnansky and Kris Wise for their leadership along with our talented ALC and Culture Committee.  Our Culture Committee served tirelessly and resulted in a well organized event.  Thank you to everyone that took time out of their busy schedules to volunteer and work within our communities and market center.  Thank you for your financial & food donations and to those volunteers who served at Our Daily Bread feeding the homeless in Denton.  Hearts for Homes and Keller Williams DMN made a difference in the lives of local elderly people by donating and delivering groceries.  Your blood donations also saved lives.  “Give Where You Live” has real meaning and heart!!!!!

Agent Tip of the Week!   

It’s that time of year when home owners are protesting their property tax values so when talking about “value”, choose your words carefully!
 
“What do you think this property is worth?”  All of us who are in the real estate profession have been asked this question hundreds of times.  You try to answer it for a customer or client each time you do a Comparative Market Analysis (CMA) or a Broker Price Opinion (BPO).  Real estate brokers and sales agents do not offer “opinions of value” – that area of expertise requires an appraiser license in Texas.
 
As a license holder, you are allowed to perform a BPO in the name of the broker as a distinct service and for a separate fee.  This is a very particular skill you can learn to do competently.  But when you do so, be careful to ensure you stay clearly within your area of expertise – and do not exaggerate the skill you’ve developed.  Real estate brokers and sales agents do not offer “opinions of value” so there is no such thing as a “broker opinion of value” (BOV) in Texas.
 
Most importantly, the CMA or BPO cannot be referred to as an appraisal, and you are required to use a disclaimer that specifically informs the user or reader that this is not an appraisal and was not developed following the guidelines in the Uniform Standards of Professional Appraisal Practice (USPAP).  See Tex. Occ. Code Sec. 1101.102(1)(A)(xi) and Title 22 TAC Sec. 535.17.
 
The Take-Away
 
Unless you hold a current appraiser license, the next time someone asks you “what do you think that property is worth?”choose your words carefully when you answer.  The most professional approach is to simply avoid using the term “value” without an appropriate prior qualifier that makes a clear distinction that you are not offering “an opinion of value”, which is the legal definition of an “appraisal” in Texas and requires an appraiser license to do competently and legally.

What is Red Day?   Introduced in 2009, RED Day, which stands for Renew, Energize and Donate, is Keller Williams Realty’s annual day of service. Each year on the second Thursday of May, associates celebrate Mo Anderson’s birthday by spending the day away from their businesses serving worthy organizations and causes in their communities.

IMPORTANT COMPLIANCE REMINDERS FROM BROKER ANNE!

 
There is a group of independent brokers who have taken it upon themselves to “police” the internet as a “courtesy.”  They’re not out to get you or us, but are contacting brokers all over the state.
In May 2018, TREC changed the rules requiring that you end your team name with the words “Group” or “Team”. 
They also made it a violation to refer to yourself as the President, Founder, Owner, Partner…..or any such title, unless you own or founded the sponsoring brokerage.
I have called TREC enforcement to get clarification, and yes, even if you are the owner of your Team or LLC……….the TREC rule still applies.
PLUS,  you must have a link to a correctly completed IABS form and a link to the Consumer Protection Notice!  The links have to be functioning!
This is all true for your LinkedIn, your Facebook, all websites, all social media………everything, everywhere!

What TREC says about commercial titles and advertising for license holders.
 
I’m a commercial agent and also the president of a brokerage.  Can I use the title “president” in my advertising?
 
No.  Even though you may hold such a title, using it in advertising implies you are responsible for the operations of the brokerage.  Similarly, a sales agent cannot use the title CEO, COO, or other similar title in advertising.  Remember, this extends to email or website addresses.

Making a difference in the lives of others and bettering the communities that we serve lies at the heart of the Keller Williams culture.

As one of our valued KW Family Members, we would love for you to join in on Red Day May 9th with your Keller Williams Dallas Metro North Family! Our theme is Give Life: Through nourishment for our neighbors in Denton County, saving lives through blood donations and writing notes with encouraging words.

How can you get involved? Here are 6 key ways:

Join us on May 9th from 8:30 am to 2:30 pm at the KW Market Center to roll-up your sleeves to pack up much-needed food for seniors that receive support from Hearts For Homes. We will also be preparing protein snack packs for Our Daily Bread where they serve 500 people through their soup kitchen and food distribution. Breakfast and Lunch will be provided, reserve your spot here: KW Red Day Market Center Nourishment Packing
Become a Blood Donor: Carter Blood Care Mobile Bus in the KW parking lot from 9 am to 2 pm. (Hours may be extended so stay tuned)
Head off to Denton with a team of 15 to serve our friends at Our Daily Bread from 8:30 am to 2:30 pm. Our Daily Bread will train you onsite and then off you go to meal prepping, serving food, restock the kitchen and clean-up. Sign-up now at:KW Red Day Serving At Our Daily Bread

4. Write 5 notes of encouragement and bring to the market center prior to Red Day

5. Be a supporter of Red Day by choosing the following:
A. Simply go to Amazon and search and choose items from our Red Day Wishlist to be shipped directly to Keller Williams Dallas Metro North: Amazon

B. Donate Gift Cards for Wal-Mart, Kroger, Costco or Target

C. Donate Canned Vegetables, Canned Fruit, Pasta Dish Sides, Instant Mashed Potatoes Packets and Canned Meat

D. Host a food drive in your neighborhood to collect and bring to the market center donation box will be in the lobby and then will be moved to storage

I am back from an amazing trip to the Canadian Rockies.  My husband and I hiked 10 miles through Banff National Park.  Fresh air and natural beauty gave me a renewed sense of appreciation for life and health. This is Wellness Week at KWDMN and I hope everyone will do something health-related this week.  We all get busy and sometimes don’t make ourselves a priority.  I am guilty of that and have not been as healthy as I should be.  If you make wellness a priority in your everyday life, please share your tips with us.  Post them on our internal Facebook page.  We can all use help every now and then.  Thank you to Kris Wise for the wellness videos and tips this week.  Let’s show our appreciation to Kris and use her “Wise” tips to make ourselves as healthy as possible.

At Family Reunion 2019 -the IALC (International Agent Leadership Council) voted to change how KW Cares donations are handled in Greensheets.

There is an automatic default for a $10.00 donation in the KW Cares donation field.

You may choose to leave this donation amount as is, or change it to any amount you wish,  or to 0.00.

You may choose to Opt Out of the donation or change it to another amount for each greensheet.

Just click on the  Opt Out option in Blue in that section.

Use of Unlicensed Assistants in Real Estate Transactions
 
May an unlicensed person, identified as such, make calls to determine whether persons are interested in buying or selling property, or have property they wish to sell, and if so, make an appointment for a licensed agent to talk to them?
 
No.   Often referred to as “telemarketing”, any such activities conducted in Texas must be conducted by a license holder.  In Tex. Atty. Gen. Op. H-1271 (1978), the attorney general concluded that a license was required.  Also, TREC Rule 535.4(e) makes it clear that all solicitation work must be conducted by a license holder.
 
Section 1101.758 of The Real Estate License Act establishes that it is a crime for an unlicensed person to engage in activity for which a real estate license is required.  The broker or sales agent who employs an unlicensed person might be criminally charged for the crime as well.  In addition, TREC may take disciplanary action against a broker or sales agent who pays or associates with an unlicensed person who engages in activities that require a real estate license.

Under what conditions would the seller check the box in paragraph 7B(3) on the contract to show that the seller’s disclosure notice is not required?

The Texas Property Code disclosure requirements are applicable to the sale of a property comprising not more than one dwelling unit, but do not apply to a transfer pursuant to a court order or foreclosure sale; by a trustee in bankruptcy; to or by a mortgage or beneficiary under a deed of trust or pursuant to a court ordered foreclosure or acquisition by a deed in lieu of foreclosure; by a fiduciary in the administration of a decedent’s estate, guardianship, conservatorship, or trust; from one co-owner to one or more co-owners; made to a spouse or to a person or persons in the lineal line of consanguinity of one or more of the transferors; between spouses resulting from a decree of dissolution of marriage or legal separation or from any governmental entity; transfers of new residences of not more than one dwelling unit which have not been previously occupied for residential purposes; or transfers where the value of any dwelling does not exceed 5% of the value of the property.

What is an AED you ask?
 
An AED, or automated external defibrillator, is used to help those experiencing sudden cardiac arrest. It’s a sophisticated, yet easy-to-use, medical device that can analyze the heart’s rhythm and, if necessary, deliver an electrical shock, or defibrillation, to help the heart re-establish an effective rhythm.
 
Our AED is located in an alarmed cabinet behind the front desk in case of an actual emergency.  Some people in our office have been trained and are CPR certified so if you are as well, please let us know.

Heather Handsford
Heather Handsford recently passed after her tough battle with cancer.  A celebration of her life will be held tomorrow, April 6th, 2019, at Mulkey-Mason Funeral Home located at 740 S. Edmonds Lane, Lewisville, Texas 75067.  If you would like to attend, Heather’s service will begin at 4:30 pm.  If you wish to donate in lieu of flowers, it is Heather’s wish that donations be made to the MD Anderson Cancer Center.   Our thoughts and prayers go out to Heather’s loved ones.

 

INSURANCE ENROLLMENT DEADLINE TODAY!

This is a note reminding everyone that the group medical enrollment will close TODAY, April 5th.  You must complete your medical questionnaire today if you want to participate in the group medical program offered through our office.

Again, it’s a two-step process.  The medical questionnaire via the website and the enrollment team for everything else.

You may contact the enrollment team at 1-877-282-0808 to sign up for additional and supplemental coverages for Dental, Vision, Short-Term Disability, Critical Illness, Accident or Life Insurance and learn about the college scholarship program.

You do not have to have medical coverage to participate in any of the other lines of coverages such as Dental, Vision etc.  Each is separate and a la carte.

image (2)Another important announcement is the Coldwell Banker parking lot will be under construction for a while so please do not use their parking lot.  We are told there is a potential leak so the lot will be destroyed by jack hammers and equipment.  We shouldn’t be using their parking lot anyway but to avoid flat tires and such, please avoid their parking lot.  Any KWDMN overflow parking is across the street at the Kohl’s store.

Do You Have a Question About TREC’s Laws or Rules? Here’s a Few Tips for Help

Did you know that TREC’s Standards and Enforcement Services (SES) staff are available to answer certain legal questions by email or phone?

SES carries out the Commission’s mission to protect Texas consumers by enforcing the laws and rules that regulate real estate brokers and sales agents, real estate (home) inspectors, residential service (home warranty) companies, and timeshare providers. SES also implements the relevant standards and reviews applications for licensure and determinations of moral character to assess the honesty, integrity, and trustworthiness of applicants.

We know you sometimes have questions about TREC rules or laws related to the specific areas SES handles and they are available to help. You may call SES directly at 512-936-3005 or you can also email your questions directly to enforcement@trec.texas.gov.

Areas for which SES can help

  • Compliance-related questions about laws and rules
  • Complaint procedures and requirements.
  • A pending case if you’re the complainant or respondent (have the file number, please, so that the call or email may be referred to the responsible party)
  • A closed case (have the file number, please, so that the case may be referred to the correct person)
  • The general areas over which the Commission has jurisdiction
  • License eligibility requirements related to background issues such as criminal history
  • Advertising – only if you’re a broker.  Calls or emails from a sales agent are referred to the sponsoring broker because the broker must ensure that each sponsored sales agent complies with TREC advertising rules.

Where can I find an answer before calling or emailing SES with a question?

The Commission has an extensive FAQ page that answers many questions. You can search by category or do a word search on the webpage to find your topic. You can also search on their website for a relevant article or form. Use the “Site Search” feature that is on the top of most pages of their website.

They also have disciplinary history information available and it’s searchable by name, license type, dates, cities, case number, and violations. You can also see a specific license holder’s disciplinary history by looking up the license holder using the “license holder search” feature and then selecting the “print license history” button.

They have extensive information on their website about filing a complaintthe complaint process, a detailed complaint overview manual, and FAQs on the complaint process (search by the category “How Are Disputes Handled?” or do a word search with “complaint”).

What else should I do before calling or emailing?

One of their staff attorneys can better assist you on a call or email when you provide the following information:

  • Your license number (if you’re a TREC license holder)
  • If you email them, please provide a call back number so their staff attorney can reach you for any needed clarification to better answer your question.
