Tax Questions from TAR:

I am a license holder who represents buyers. Even though I always rebate a portion of my commission to my buyer clients at closing, my broker provides me a 1099-MISC for the full commission I was to receive.
Is that correct?

Yes. Your broker is required to provide a 1099-MISC to you for the full amount of the commission you earned. Whether you direct a portion of your commission to be paid to someone else at closing does not affect that requirement.

When I rebate a portion of my commission to my client, should I provide a 1099-MISC to my client if the amount I rebate is more than $600?

No. Your client is not providing a service to you, so you are not required to provide a 1099 to the buyer.

Can you practice real estate transactions outside of residential?

Referring to our Independent Contractor Agreement, Paragraph 2 G:
 
Limited authority. Contractor agrees that its authorization from Licensee is strictly limited to residential real estate activities, such as listing, selling, and leasing real properties. Contractor may not engage in any: commercial, REO, short sales, property management, or other real estate transactions that require advanced proficiency or education (collectively, “Complex Transactions”), without the express written approval of both Contractor’s team leader and of Licensee prior to participating in such Complex Transactions.
 
If you are interested in practicing real estate transactions outside of residential, i.e. Commercial, Property Management, etc., please see me before engaging in any complex transactions or transactions that require advanced training.  We want to help you be proficient so you can assist your clients while limiting liability and providing expert client representation.

DOM – Did you Know?

How do I reset the CDOM field?

A listing must be Cancelled, Sold or Expired for at least 30 calendar days before putting back in to the MLS (under ANY status).  Entry as incoming or coming soon before day 31 will cause the system to pick up the days on market from the previous listing.

How are Days on Market Calculated?
Days On Market (DOM) are calculated in Matrix based on the List Date and Contract Date… but only once the listing status is changed to Pending
Since NTREIS describes any listing with Active in the status as available for showings and back up contracts, the DOM continue to count until it is made Pending which indicates it is no longer available to show and the seller is not taking any further offers. NTREIS MLS STATUSES
When a status is changed from A/AO/AC/AK directly to sold the system does not calculate the DOM based on the contract date.  When the listing goes to pending then sold it queues the system to stop counting DOM –  and go back to the list date/contract date and recalculate.  To keep accurate DOM, the listing needs to move to pending first before sold.  
While the tendency is to keep a listing ‘open’ as long as possible in case something falls through, doing so skews the DOM.
Keep in mind that once the seller accepts a back up offer, the listing should then be changed to pending in the MLS since the seller cannot accept another offer (remember there is no such thing as multiple backups).  Advertising the listing as available for showing and/or offers through an AC/AK status is misleading once a back up is in place.  
If the status is contingent upon an action, but there is a valid executed back up, it is no longer available unless the original contract falls out and the back up moves to first position.  The MLS status can then be changed from Pending to AC/AK per the new contract – again soliciting showings and other back up offers.
DOM affects everything from the listing itself, to CMAs, market reports and agent stats. Best practice suggests that the listing be edited to pending no later than the evening before or the morning of closing and then edit to SOLD after the closing.  This allows the system to go through the program correctly to re-calculate the DOM.

Our 2018 Awards Ceremony and Breakfast was yesterday and congratulations to all of our award recipients.  It was a great turnout and a pleasure to celebrate with many of you yesterday at the beautiful Courtyard by Marriott Flower Mound.  It was a lovely ceremony and the breakfast was delicious.  To our award winners, it was a joy to honor YOU!  If you did not receive an award yesterday, this is YOUR year and I look forward to YOUR accomplishments in 2019 so let’s get busy and rock the real estate world.  The world is YOUR oyster!

Agent Tip of the Week! 

 Cast Your Security Net Over Phishing

Learn how to avoid falling for email scams.

A phishing scam is a type of fraud that can come in many different forms. These scams not only employ various online techniques such as fake emails and pop-up ads but can also include phone calls. The people behind these scams often use fear tactics in order to get their victims to take the bait.

Phishing is essentially an online con game, and phishers are nothing more than tech-savvy con artists and identity thieves. They use spam, malicious websites, email messages, and instant messages to trick people into divulging sensitive information. Banking information, credit card accounts, usernames, and passwords are just some of the information phishers seek to exploit.

5 common phishing scams, and how to protect yourself from them

Since phishing scams are designed to appear as if they come from reliable sources, it is smart to know the difference between real and fraudulent messages and how to spot some of the clues that a message may be a scam. Here is a list of five common phishing scams and ways to help protect yourself against falling for them.

1. Email phishing scams

An email phishing scam is a fraudulent email message that appears to be from a person or company known to the victim. It attempts to illegally gather personal and/or financial information from the recipient.

A phishing message typically includes at least one link to a fake website, designed to mimic the site of a legitimate business. The message entices the recipient to provide information that could be used for identity theft or online financial theft.

How to help protect yourself against email phishing scams:

  • Do not click any links or download any attachments in the suspicious email. Instead, open up your web browser and go to the website in question by typing it into the URL bar.
  • Be vigilant and pay attention. Phishers have been known to use real company logos to make their communications seem legitimate. They also use spoofed email addresses, which are similar to the actual company’s address. However, the address may be misspelled slightly or come from a spoofed domain.

2. Vishing scams

Vishing (voice or VoIP phishing) is the voice version of email phishing. “V” stands for voice, but otherwise, the scam attempt is the same. It is a phone scam in which individuals are tricked or scared into handing over valuable financial or personal information to scammers.

How to help protect yourself against vishing scams:

  • Never give personal information over the phone. Hang up, look for the number of the company on their website, and call them directly to make sure it was a legitimate call and request. 
  • Never call the number the caller provides. When looking up the company website, make sure it is legitimate. Fake websites often contain misspellings and other telltale signs.

3. Tech support cold call scams

Tech support cold calls are when a scammer calls a potential victim claiming to be from a reputable security company. They lie and say they found malware on the victim’s computer.

The criminal pretends to offer a solution by getting the user to install a type of remote desktop software. This allows the attacker access to the computer in order to install real malware. In addition to attempting to install malware on the machine, these scammers will often ask for a fee to “fix” the issue.

How to help protect yourself against tech support call scams:

  • If a person calls claiming to work for a specific, well-known company, look up the phone number online and tell them you will call them back.
  • Never allow remote access to your computer.

4. Pop-up warning scams

Pop-ups occur when someone is browsing the internet and sees a small graphic or ad appear on their screen. Usually, pop-ups are related to the content being viewed and link to another website with similar content or merchandise related to the content.

Malicious pop-ups can be terribly intrusive, making it difficult for the user to close the pop-up window. These pop-ups may display a message stating that the computer is infected with malware and offer a phone number for help with removing the malware. Often, the cybercriminals make pop-ups look like they come from a trusted source, such as our own Norton products, in hopes of appearing to be legitimate.

How to help protect yourself against pop-up scams:

  • Examine the message closely. Look for obvious signs of fraud such as poor spelling, unprofessional imagery, and bad grammar.
  • Remember, when in doubt, never click on the pop-up. Instead, open up your antivirus software and run a system scan.

5. Fake search results scams

Fraudulent companies frequently use paid search ads for their “support services” as if they were legitimate, well-known companies. These paid listings can appear at the top of a search results page, a prime location. These results, which can look like the real thing, can promise support offers that seem too good to be true in hopes of luring in a victim, whose top concern is to fix their computer. Unfortunately, when you click on the ad, malware may begin to download to your device, compromising the security of your information and adding to your computer woes.

How to help protect yourself against fake search results scams

  • Examine the URL closely. Creators of fake websites will sometimes try something called typo squatting, where they register a domain name that looks similar to the URL of the legitimate site they’re duplicating.
  • Use a secure search service, such as Norton Safe Search, to know if the site you’re about to visit is safe.

What to do if you’ve been scammed

If you think you’ve been the victim of a phishing scam:

  • Change your passwords. Your computer, financial institutions, and any other password-protected websites that you visit should be updated.
  • Run a full system scan for viruses on your computer.
  • Contact your bank to report that you may have been the victim of fraud.
  • File a complaint with the anti-fraud bureau:

NOTICE

MLS Rules For Purging Listings and Media

GLAR is seeing an uptick with agents deleting photos prior to changing status to sold or cancelled.  NTREIS has a schedule as to when they purge photos (attached), and photos are to remain on the listing until then as they are needed for comps and appraisals.

 

Some buyers may want them out, assuming that takes them off the internet, but deleting from the MLS does not necessarily remove them from other websites. Many do not pull new image files once they have posted the images.  Removing them from Matrix only affects the agents and appraisers who need them for comps.

 

An example of another complication is a KW agent cancelled a listing and the new listing agent is using her photos.  Because the agent deleted all but the first photo there was no way to demonstrate that those photos belong to the first (cancelled) listing / listing agent.

If you already signed it, then you are good and no further action is needed.  If you have not signed it, we will unfortunately start imposing a fine as this is required by our Broker and must be signed by all licenseesThank you!

Agent Tip of the Week! 

TAX TIPS:  It’s tax season and you shouldn’t wait until the last minute.  
 

Here are some common deductions from TAR for REALTORS® to get started:

  1. Vehicle mileage or expenses: Make all that time in the car meeting clients and driving from property to property work for you. There are two ways to handle vehicle deductions: taking the standard per-mile deduction or deducting actual vehicle-related expenses. Determining which one is best for you can depend on how many miles you drive and what you drive.
  2. Marketing and advertising: Both of these can be significant line items for REALTORS®. Don’t forget to deduct the design and production costs of advertisements along with the costs to place them.
  3. Meals and entertaining: You can deduct 50% of meals if you are traveling on business or if you are dining with clients or industry professionals for business purposes. Refreshments and food at an event open to the general public, like a well-advertised open house, is 100% deductible.
  4. Where you work: Do you have a home office or pay for a desk or office at KW? You can deduct costs associated with one of those, but not both. The home office deduction has a simple version and an option that allows for deducting all related costs, and again, determining which is best for you will take some investigating. Don’t forget that your office supplies are often deductible.
  5. Professional development and travel: Did you attend KW Family Reunion or Mega Camp last year?  If so, the travel to conventions and the costs of any CE you take while there are good examples of potential deductions.
  6. Memberships, licenses, fees, and insurance: The cost of your REALTOR® membership is largely deductible—minus the part that’s used for political activities, which is noted on your invoice. Any licensing fees, business insurance, and E&O insurance are also deductible.
  7. Software and business tools: If you use software such as a customer relationship manager (CRM) or other business tools to manage your business, those costs are deductible. Even the cost of a program like TaxBot,https://www.texasrealestate.com/members/member-benefits/alphabetical-list-of-benefits/taxbot/a TAR member benefit that helps you turn expenses into deductions, can be deducted.

Make sure to check with a tax professional when making business deductions as many of these deductions have complex rules and involve keeping detailed records.

Information on Critical Tax Deadlines for the 2018 Tax Year

The official deadline to file your federal income tax return each year can be shifty. April 15 falls on a Monday and it’s not a holiday, so the filing deadline for your 2018 tax return is indeed April 15 in 2019. You have until October 15, 2019 if you file a request for an extension on or before that date.

What “Non-Disclosure” Doesn’t Mean for Reporting Prices to the MLS*

 

Do I have to report my client’s sales price to the MLS?

Yes. MLS rules state that sales of listed property, including sales prices, shall be reported promptly to the MLS by listing brokers. As such, the Residential Real Estate Listing Agreement Exclusive Right to Sell (TAR-1101) includes a notice in Paragraph 6(A) that goes over this requirement so that the client is aware of their broker’s obligations.

It is a misconception that Texas’s status as a “non-disclosure” state means that a listing broker does not have to disclose sales data to her MLS. That is not true. Rather, it means that the state government, including local appraisal districts, cannot force anyone to provide the sales price to it.

Agent Tip of the Week!

Determining the Effective Date of the Contract

The effective date is determined by the final date of acceptance. The final date of acceptance is the date on which the contract becomes binding between the Buyer and Seller, in other words, the date that both the Buyer and Seller have agreed to ALL terms of the contract and have executed the contract. Four elements must be satisfied for final acceptance to occur:

1. The final contract must be in writing.

2. The Buyer and Seller must sign the final contract, including the initialing of any handwritten changes to the initially drafted offer, if applicable.

3. Acceptance must be unequivocal, in other words, clear, having only one possible meaning, and with no shred of doubt.

4. The last party to accept must communicate acceptance back to the other party or the other party’s agent.

The effective date is the date when the fourth element is made after the other three elements are satisfied. All contract performance requirements or periods of performance then begin to run.

5 simple New Year’s resolutions every real estate agent should make*

Make sure this year’s goals stick by simplifying them.

The first rule of resolutions is they need to be attainable. The easier a resolution is, the more likely we are to reach it, which makes us feel good about ourselves. And everyone knows confident agents sell more homes.  

1. Turn off your smart phone for at least 5 minutes a day

It’s for your own sanity really. For just five minutes a day, whenever you want, turn your phone off — all the way off. Use that five minutes to recall simpler times.

2. Get one new lead each week

You don’t have to become a lead machine overnight, but you do need to actively gain leads to grow your business. Any agent with an active Instagram account can pick up 52 new followers a year.

3. Post once a week on Facebook, Instagram or Twitter

No matter how little value social media has in your personal life, it serves a professional purpose.  See above.

4. Get your CE done at least one week before it’s due

Continuing education is a part of the real estate gig. Save yourself stress by getting it done early this year.

Online continuing education courses are now available on all devices. You can work on getting your CE knocked out while waiting on a buyer to tour the same house for the third time.

5. Turn your car into a true mobile office

Practically everywhere is an office when you’re a real estate agent. Your car is basically your mobile office.

Because you already have a mobile plan with unlimited data and hot spotting (right?), make your vehicle even more functional with a laptop steering wheel desk, mobile printer, solar recharger for all the devices and the Handpresso auto espresso machine. Don’t forget to save the receipts for a tax deduction.

As you think about what you want to accomplish in the coming year, go big with your long-term goals, but be realistic about the steps it will take to get there.
