Fantastic Friday and Welcome to Rosemary’s Rubies! 

I am a ball of emotions today as we celebrate two lovely ladies and thank them for their valuable service to our market center.  Please join us for a reception today from 4:00 – 5:30 p.m. in our upstairs training room as we send Megan Neihart and Venus Mendoza onto their next grand adventures.  We will miss them both and wish them much success!

IN MEMORY OF HEATHER HANDSFORD

Heather Handsford

We lost one of our beautiful agents, Heather Handsford, last week after her tough battle with cancer.  A celebration of her life will be held next Saturday, April 6th, 2019, at Mulkey Mason Funeral Home located at 740 S. Edmonds, Lewisville, Texas 75067.  Service will begin at 4:30 pm. If you wish to donate in lieu of flowers, it is Heather’s wish that donations be made to the MD Anderson Cancer Center.   Our thoughts and prayers go out to Heather’s family and friends.

Agent Tip of the Week!

What’s subagency?

Subagency occurs when a listing broker extends his or her agency relationship with the seller to agents outside of the brokerage. These cooperating subagents owe their fiduciary duty to the seller. If subagents of a listing broker find a buyer for a property, that buyer is treated as a customer, not a client.  As a subagent, a license holder acts as a subagent when aiding a buyer in a transaction without an agreement to represent the buyer.  A subagent can assist the buyer but does not represent the buyer and must place the interests of the owner first.

Our brokerage does not engage in a subagency relationship as it can cause confusion as to who represents who, who do we owe our fiduciary responsibility to and who is paying which broker?  A written agreement isn’t required for an agent to work on behalf of a buyer, but without one, there’s a greater risk of misunderstandings between you and the buyer and potential issues involving subagency and your commission.  Our brokerage prefers exclusive representation of an owner/seller or client/buyer so always use an Exclusive Right To Sell Listing Agreement and/or Buyer/Tenant Representation Agreement.  If not, our broker suggests that a referral fee agreement be done instead of subagency.

MEDICAL AND ANCILLARY INSURANCE FOR 1099 REAL ESTATE AGENTS!

Please read the information below regarding Insurance options for 1099 Real Estate Agents in our Market Center.  This is a follow-up from Mike Egel with Bridge Insurance– who presented this at our Partner Meeting on Tuesday.

As mentioned during our Partner Meeting, here are some specific talking points:

Benefit plan summaries, videos, and contact information for the Bridge Insurance team and the Enrollment Center can be found on this website.

Open-Enrollment

We are shooting for a June 1st effective date for all plans and benefits.

The deadline for Major Medical applications is April 5th. After this date, we will not accept any more Major Medical applications from existing agents.

Each agent will be contacted by the enrollment team. They will explain each product, including the rates, and will help you sign up for any benefits you choose to protect you and your business.

Agents can call the enrollment team, instead of waiting for them to call you. (877) 282-0808

Anyone interested in applying for Major Medical insurance, will need to fill out an online application at www.formfire.com

If your spouse and/or dependents are wanting to participate in this plan, you will need their health history, SSN, DOB and prescription information as well.

Agent Tip of the Week!

 

Financial Matters Do Matter!


Can a sales agent have an escrow account?

No. Rule 535.146(b)(2) prohibits a sales agent from having an escrow account. The sales agent must turn all money received over to the sales agent’s sponsoring broker.

Can a sales agent have a commission check written to the sales agent’s own corporation or Limited Liability Company? If so, does that entity have to be licensed as a real estate broker?

All commissions must be paid through the agent’s sponsoring broker.[TRELA §1101.651(b)] Further, a business entity that receives compensation on behalf of a license holder must be licensed as a broker. [TRELA §1101.355(c)]

Can a sales agent receive or pay a commission to a party in a real estate transaction?

No. A sales agent may not accept compensation for a real estate transaction from anyone other than the broker the sales agent was associated with at the time the commission was earned and may not pay a commission to a person except through the sales agent’s sponsoring broker. [TRELA §1101.651(b) and (c)]

Violations may be subject to disciplinary sanctions by the Sponsoring Broker along with TREC, including but not limited to, license revocation, license suspension, reprimand and/or an administrative penalty.

Megan’s Memo! 

Recently, we’ve had an issue of agents letting outside people in through one of our other doors. These doors are locked for security reasons and NO ONE should be allowed to walk through them unless they are an agent with a fob. If someone tries to get through another door, please direct them to our front desk door. This way, I can do my job and manage who is walking around our office unchecked. We want to keep you guys as safe as possible and we can’t do that if we don’t know who’s in the office!

Tax Year 2019: What’s New From the IRS?

 

Tax law changes are nothing new – but when they occur, you want to be in the know. The IRS has announced the following projected changes for this tax year:

  • Standard deduction – If you’re married filing jointly, your standard deduction rises to $24,400, up$400 from 2018. If you’re a single taxpayer or married filing separately, the standard deduction is $200 higher at $12,200. If you file as a head of household, your standard deduction is $18,350, up $350.
  • Personal exemption – The Tax Cuts and Jobs Act suspended the personal exemption.
  • Tax brackets – The following are adjusted for inflation:

  • Retirement account contribution limits –These have risen $500 from 2018. Your total contributions to all of your traditional and Roth IRAs cannot be more than $6,000 ($7,000 if you’re age 50 or older) or your taxable compensation for the year, if your compensation was less than this dollar limit.
  • Itemized deductions – The Tax Cuts and Jobs Act changed the rules on these. Check with your tax professional for details.
  • Alternative Minimum Tax (AMT) – For unmarried individuals, the exemption amount rises to $71,700 and begins to phase out at $510,300. For married couples filing jointly, the exemption amount is $111,700, and the exemption begins to phase out at $1,020,600.
  • Estate tax exclusion – The basic amount rises to $11,400,000, up from a total of $11,180,000 for estates of decedents who died in 2018.
  • Gift tax exclusion – The $15,000 amount remains the same as it was in 2018.

Creating Outstanding Realtors for Excellence –  is a fast track program to provide agents with the foundation needed to launch their business, and get off to a fast, exciting start in real estate!

This 90 minute orientation class covers how, what, when and where details necessary to get your Real Estate business started with Dallas Metro North.  You will be introduced to “Path to Success”. Path to Success is your first 100 days business guide.
