Agent Tip of the Week! 

If you have not changed our broker name on your Information About Brokerage Services (IABS) form, please make sure it has Anne Lakusta as broker, License #452271 (NOT Barbara Trumbull).  TREC requires you have links to a completed Information About Brokerage Services and the Consumer Protection Notice on all public websites and social media sites.  Your IABS form should be filled out completely when it is linked to your website as well as when it is provided during the first substantive communication.  If not presenting the IABS in person, you may attach your completed IABS to an email or provide a link to your completed IABS in the body of your email (above your signature line). 
 
  I have been notified this week that some of our agents still show Barbara Trumbull as our broker and some agents do not have their links posted properly.  Please read the following TREC tips for posting the IABS and Consumer Protection Notice:

Ideal way to post IABS and Consumer Notice to comply with our rules:

Post a link to a completely filled out TREC IABS form labeled “Texas Real Estate Commission Information About Brokerage Service,” on your business website homepage, in a readily noticeable place in at least 10 point font.

Post a link to the Consumer Protection Notice labeled “Texas Real Estate Commission Consumer Protection Notice” on your business website homepage in a readily noticeable place in at least 10 point font.

Acceptable alternate ways to post your IABS and Consumer Notice:

Post an image of the completed IABS form, or the Consumer Protection Notice and label the image “Texas Real Estate Commission Information About Brokerage Services” or “Texas Real Estate Commission Consumer Protection Notice.”

  • You can save a PDF as a .jpg and post it as an image on Facebook, Twitter and Traditional Websites.
  • On Facebook, make the image a “Favorite” image so the completed form stays at the top of your images.

Remember: The TREC IABS form must also be provided to consumers at the time of your first substantive communication by personal delivery, mail or email.

Email Signature Instructions

How to update your @kw.com email signature

If you are not familiar with your how to access and change your @kw.com email signature, remember it is a Business Gmail account, so you change it the same way you do any Gmail account.

To update your signature, follow these instructions:

  • Open your Gmail or @KW.com email

  • Click on the settings “wheel” at the top right corner just under your picture or your initials.

  • Click on Settings

  • Under the general settings tab that opens first by default, scroll down to where is says “Signature”

  • Click the button that allows you to enter a signature in the space provided.

Items to have in your signature line:

You can personalize this, like adding your name, contact info, brokerage info, etc. However there is also some required information. 

1. Wire Fraud notice – copy and paste the below wire fraud notice into your signature line. You can find it at the bottom of any email that is sent to you from our staff, also see below in yellow. 

2. Brokerage information – you always want to identify your broker. TREC is strict on being sure it is clear you are a realtor, and identifying your broker.

3. Texas Real Estate Commission Forms/Notices – you want to provide a link to your completed TREC IABS form and the TREC Consumer Protection Notice.

You can create an email signature image by logging in to Michael Lewis Marketing Suite at www.MichaelLewisMarketingSuite.com under the menu item “free stuff”. Just make sure you add the needed information (see above). 

To find out how to create the needed links, go to www.KWMetroNorthTech.com and on the top menu, select “Tech Videos” and you will see Tammy’s Tech Tip videos. These will help you create your links and signature.

Most of you already know Michelle Peters-Hill, who worked alongside of Erin Fulton and shared an office with her.  For those that may not know Michelle, I suggest you get to know this amazing and talented lady.  I am pleased to announce that Michelle is now Stacey Buettner’s Executive Assistant.  You can find Michelle in her office next to Jeri McGuire, MCA.  Michelle will also be assisting all staff members and is in charge of our training calendar.   I would like to share some interesting things about Michelle so everyone can get to know her better:
 
Michelle comes to us with an entirely different background.  With a degree in Education Science and Finance, her passion has always been about our children and their future.   But being from Oklahoma, Michelle found that the resources were not there (still true today) so she packed up and moved to Texas.  Once here she took on the fashion/retail field with a corporate position at Gadzooks for 25+ years before retiring and starting her small shoe business, Itzy Bitzy.  Thirty years, 5 Kids and 1 granddaughter later, she and her husband Rob live in Double Oak with their 2 dogs and their family chickens.

Agent Tip of the Week! 

NEW TREC Advertising Requirements:
New Rules adopted November 2017 and are effective May 15, 2018.
 
Here are some important facts and guidelines to follow:
  • All DBAs (assumed business names and team names) must be registered with TREC by the brokerage BEFORE the name can be used in advertising.  Please speak to me about this process so I can help you!
  • All DBAs (individual names and team names) must end with the word “Team” or “Group”.
  • Team names cannot contain terms that imply that the team is offering brokerage services independent of the broker, even if it ends with the word “Team” or “Group”.
  • “Team” or “Group” must be the same size font as the rest of your DBA or team name.
  • Each advertisement must include the following in a readily noticeable location in the advertisement:
(1) the name of the license holder or team placing the advertisement; and
(2) the broker’s name in at least half the size of the largest contact information for any sales agent, associated broker, or team name contained in the advertisement.
  • An advertisement violates TRELA 1101.652(b)(23) if it is an ad:
(1) that uses a title, such as owner, president, CEO, COO, or other similar title, email or website address that implies a sales agent is responsible for the operation of the brokerage;
(2) that contains a team name with terms that imply the team is offering brokerage services independent from its sponsoring broker, including, but not limited to “realty”, “brokerage”, “company” and “associates”.  

SPECIAL NOTE: At a meeting on February 12, the Commission instructed agency staff to research and determine the steps necessary to remove the term “REALTY” from the list of terms that would imply a team is acting independently of a sponsoring broker and accept the term “REALTY” when used in a TEAM NAME.

Has everyone filed their 2017 tax return?  If not, I have good news. You get two extra days to file this year so your deadline is next Tuesday, April 17th.

If you can’t pay what you owe the IRS by Tax Day, here’s what to do:

For taxpayers who owe and don’t file, the penalty can be steep: 5 percent of the unpaid balance for each month it’s late, up to a maximum of 25 percent of the amount due.

As long as you file your return, the penalty for owing is less; generally 0.5 percent for each month the balance remains unpaid.

Filing for an extension only delays when your return is due. It will not avoid the penalties for any taxes owed.

NOW THAT YOU KNOW, GO HAVE A GREAT WEEKEND BEFORE YOU OWE!!!!!

New Form Changes!
 
Please pay attention to Paragraph 5 of the One To Four Family Residential Contract.
 
Paragraph 5 is one of the most significant changes and is amended to require Earnest Money to be delivered within 3 days of the Effective Date.  It also allows the Seller to terminate the contract if Buyer fails to timely deliver the Earnest Money.
 
5. EARNEST MONEY:
Within 3 days after the Effective Date, Buyer must deliver $_____________ as earnest money to _______________________, as escrow agent, at _______________________________________________ (address). Buyer shall deliver additional earnest money of $____________ to escrow agent within _____ days after the Effective Date of this contract. If Buyer fails to deliver the earnest money within the time required, Seller may terminate this contract or exercise Seller’s remedies under Paragraph 15, or both, by providing notice to Buyer before Buyer delivers the earnest money. If the last day to deliver the earnest money falls on aSaturdaySunday, or legal holiday, the time to deliver the earnest money is extended until the end of the next day that is not a SaturdaySunday, or legal holiday. Time is of the essence for this paragraph.

Have you heard a lot about referrals lately? And a new thing called your referral network? This is part of the incredible new technology that Keller Williams is providing to help you grow your business. Here is what you need to know!

  1. You now have a referral network where you can send or receive invitations with other Keller Williams agents in any location.
  2. It is important to build your network now! (This is opportunity for growth & income!)
  3. Make sure your KW Connect Profile is setup, then get started!
  4. (refer to www.KWMetroNorthTech.com Tech Videos, Tech How To Docs
  5. You can access your referral network via KW Connect or Kelle
  6. You can send and receive actual referrals through your network now!
  7. Check Kelle daily to see if you have received a referral (they can expire if you do not reply).

Please pay attention to Paragraph 21 of the Residential Real Estate Listing Agreement.
 
21. ADDITIONAL NOTICES:
 
I. If Seller is a “foreign person” as defined by federal law, a buyer may be required to withhold certain amounts from the sales proceeds and deliver the same to the Internal Revenue Service to comply with applicable tax law. A “foreign person” is a: (1) nonresident alien individual; (2) foreign corporation that has not made an election under section 897(i) of the Internal Revenue Code to be treated as a domestic corporation; or (3) foreign partnership, trust, or estate. The definition does not include a resident alien individual. Seller notifies Broker that Seller  is  is not a “foreign person” as defined by federal law. If Seller is unsure whether Seller qualifies as a “foreign person” under federal law, Broker advises Seller to consult a tax professional or an attorney. J. Broker advises Seller to refrain from transmitting personal information, such as bank account
 

Paragraph 20 of the One to Four Family Residential Contract is amended to clarify “applicable law” and an “affidavit” when a Seller is a “foreign person”:

 
20. FEDERAL TAX REQUIREMENTS: 
 

If Seller is a “foreign person,” as defined by Internal Revenue Code and its regulations, or if Seller fails to deliver an affidavit or a certificate of non-foreign status to Buyer that Seller is not a “foreign person,” then Buyer shall withhold from the sales proceeds an amount sufficient to comply with applicable tax law and deliver the same to the Internal Revenue Service together with appropriate tax forms. Internal Revenue Service regulations require filing written reports if currency in excess of specified amounts is received in the transaction.

Tammy’s Tech Tip this week is about a tiny little tool with a big purpose! If you use Windows 10 and have not been introduced to the “Snipping Tool” fondly renamed by me as “the snipper” – you need to meet! A very quick way to copy all or part of your screen and save it in a file. It has more options than just a “print screen” – More options, fewer steps! Do you ever need to change some file type into an image file? Show someone screenshot of all or part of your screen? This makes those tasks and many others very quick and easy. Go to link for a great description. The quick version is to go to your Windows 10 search bar, type in “snipping tool” and select it. Here are some great instructions!

Learn about the power of the internet and social media marketing.  Statistics show that almost all home buyers & sellers are using the internet & social media, yet most Realtors are still unaware of how to take advantage of some of the most effective internet marketing tactics. Technology can also be a point of frustration for Realtors because while most understand that technology and internet marketing is important, they either don’t understand how to use it to get leads or they simply don’t know where to start and get completely overwhelmed. This course will break down these powerful marketing tactics and by the end of the course, the agent will pick one or two marketing strategies that suit their business and leave with an action plan. By implementing this action plan, the agent will get more leads which will result in more closings.

Creating Outstanding Realtors for Excellence –  is a fast track program to provide agents with the foundation needed to launch their business, and get off to a fast, exciting start in real estate!

This 90 minute orientation class covers how, what, when and where details necessary to get your Real Estate business started with Dallas Metro North.  You will be introduced to “Path to Success”. Path to Success is your first 100 days business guide.

Cinda Knight, Productivity Coach, facilitates this class and program.  If you have questions about the CORE program, Cinda’s email is cinda@kw.com.
